📜 Terms & Conditions

Effective Date: October 1, 2024

These Terms & Conditions ("Terms") govern all quotes, bookings, and services provided by Poop Suckers Septic Service South East Idaho LLC ("we," "our," or "us"). By requesting a quote, scheduling, or receiving services, you ("Customer") agree to these Terms.

1) Scope of Work

We perform septic and related services as described on your booking confirmation or invoice. We follow applicable local, state, and environmental regulations. We may modify or decline work if conditions are unsafe, inaccessible, unlawful, or outside the stated scope.

2) Estimates, Upfront Pricing & Adjustments

Good-Faith Estimates. Quotes are provided in good faith based on Customer-supplied information (e.g., tank size, location, access, condition).

Standard Pumping Rate. Unless otherwise stated, pumping is billed at $0.50 per gallon. If actual gallons, conditions, or site constraints differ from information provided, Customer authorizes us to bill additional gallons and reasonable labor/materials at posted or quoted rates.

Extra Labor/Materials. Services such as tank locating, exposing lids, line clearing, root removal, frozen system mitigation, or additional technician time may incur added charges. We make reasonable efforts to notify you before performing extra work when feasible.

Disposal/Permit Pass-Through. Governmental permit requirements and disposal facility fees/surcharges may change without notice. Customer authorizes pass-through of such third-party fees applicable on the service date.

Misrepresentation/Unknown Conditions. If information provided is inaccurate, incomplete, or conditions are undisclosed (e.g., covered lids, unpermitted modifications, access barriers), estimates are not binding and pricing may be adjusted.

3) Payments; Authorization; Nonpayment & Lien Rights

Payment is due in full at time of service unless otherwise agreed in writing.

By scheduling, Customer authorizes charges to the provided payment method for all services rendered, including adjustments per §2.

Unpaid balances may incur late fees as permitted by law. Returned payments/chargebacks may incur a $35 fee.

We may pursue lawful remedies including mechanics' liens and recovery of reasonable collection costs and attorneys' fees.

4) Scheduling, Rescheduling & Company Cancellations

Appointment Windows. Arrival windows are estimates and may vary due to weather, road conditions, job duration, or emergencies.

Company Rights. We may delay, reschedule, or cancel any service at any time, without penalty or liability, due to equipment failure, truck breakdowns, staffing/illness, weather/road closures, safety concerns, overbooking, or other unforeseen events. We will use reasonable efforts to notify you and reschedule at the earliest available time.

No Consequential Liability. We are not liable for any loss, inconvenience, or consequential damages arising from delay, rescheduling, or cancellation.

5) Access, Utilities & Site Conditions

Customer must provide safe, unobstructed, and drivable access for service trucks and personnel, including gate codes, pets secured, vehicles moved, snow/ice cleared, and adequate clearance near lids/clean-outs.

Customer Warranties. Customer warrants lawful access to the system and is responsible for locating/marking private utilities (sprinklers, private lines, shallow conduits) and septic components (tanks, lids, clean-outs).

We are not responsible for damage to unmarked or inaccurately marked private utilities, landscaping, or surfaces reasonably necessary to access the system.

Service vehicles may leave ruts, impressions, or surface marks; Customer assumes responsibility for cosmetic effects of necessary access.

6) Locate/Dig Authorization & Restoration Limits

Customer authorizes minimal excavation or surface removal as reasonably necessary to locate/expose tanks, lids, or clean-outs. Standard restoration is limited to backfilling disturbed soil. Hardscape/landscape restoration is excluded unless separately quoted and approved in writing.

7) Subcontractors

We may use qualified subcontractors for portions of the work. These Terms apply to all work performed on our behalf.

8) Force Majeure

We are not liable for delay, nonperformance, or cancellation caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, power/utility failures, equipment breakdowns, labor shortages, illness, governmental actions, supply disruptions, or road closures.

9) Risk Allocation: No Warranties; Limitation of Liability

No Warranties. To the maximum extent permitted by Idaho law, services are provided "AS IS" and "AS AVAILABLE," without any warranties or guarantees, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability. To the maximum extent permitted by law, our total liability for any claim arising out of or related to the services shall not exceed the amount Customer paid for the specific service at issue. We are not liable for any indirect, incidental, special, exemplary, or consequential damages (including loss of use, loss of time, inconvenience, property value impacts, or lost profits).

10) Indemnification

Customer agrees to indemnify, defend, and hold harmless Poop Suckers Septic Service South East Idaho LLC, its owners, employees, and contractors from claims, damages, fines, penalties, and reasonable attorneys' fees arising out of: (a) Customer's breach of these Terms; (b) inaccurate, incomplete, or misleading information provided by Customer; or (c) hazards or site conditions not created by us.

11) Dispute Resolution; Governing Law & Venue

The parties will first attempt good-faith resolution.

These Terms are governed by the laws of the State of Idaho.

Venue: Any action shall be brought exclusively in the state courts located in Bingham County, Idaho (small-claims actions may proceed directly).

12) Changes to Terms

We may update these Terms at any time. The version in effect at the time of booking governs your service; material changes made after booking will not apply to that service unless agreed in writing.

13) Severability; Entire Agreement; No Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with your written estimate/invoice and our posted policies (including our Privacy Policy), constitute the entire agreement regarding the services. Our failure to enforce any provision is not a waiver of that provision.
